WORK SESSION MEETING

 

Council Chamber:

 

     Mayor Burzichelli presided at a Work Session Meeting of Council held on the above date and place.

 

     Members present were: Haynes, Giovannitti, Hamilton, Kidd, Morina, Tedeski.  Absent:  None.  

 

     Mayor Burzichelli called the meeting to order.

 

     Mayor Burzichelli read the opening statement regarding the Open Public Meetings Act.

 

     Mayor Burzichelli opened the floor to the public.

 

     Benita Johnson, Cedar Knoll Apartments, discussed the New Jersey Transit Bus Stops.  She stated if most of the problem with the bus stop in front of Gene’s Classic Cars is trash then the Borough should provide a trash can.  She also discussed the need for the bus stop.

 

     Mayor Burzichelli stated presently there are three (3) bus stops and the one in discussion is in front of the car dealership.  He further stated that the Borough wants to keep the bus running in Paulsboro and was an advocate in keeping the bus stops.  He suggested the bus stop be moved two (2) blocks in either direction but it has to get resolved.

 

     Theresa Cooper, Buck Street, stated there isn’t any protection from the weather.

 

     Mayor Burzichelli stated there was more problems when the Borough supplied the shelters and many towns do not have shelters.

 

     There was further discussion regarding the removal and placement of the bus stop in front of Gene’s Classic Cars.

 

     There wasn’t any further public participation.

     R. #156.10:  RESOLUTION PROVIDING FOR THE PAYMENT OF THE BILLS OUT OF THE 2010 BUDGET.  Haynes moved and Hamilton seconded to pay all bills properly signed and adopt R. #156.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Morina, Tedeski.  Nays:  None.  Abstained:  Kidd.  Motion carried.

 

     Mayor Burzichelli stated there is a bill to be added to the bill list which is P.O. #39276 to pay for the Streetscape Phase II project to Lexa Construction in the amount of $47,955.55. 

 

     Haynes moved and Hamilton seconded to add Purchase Order No. 39276 to the bill list to be paid.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     R. 157.10:  RESOLUTION PROVIDING FOR THE INSERTION OF A SPECIAL ITEM OF REVENUE IN THE BUDGET IN THE BOROUGH OF PAULSBORO, COUNTY OF GLOUCESTER AND STATE OF NEW JERSEY PURSUANT TO N.J.S. 40A:4-87 (CHAPTER 159, P.L. 1948).  Haynes moved and Hamilton seconded to adopt R. #157.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     R. #158.10:  RESOLUTION AUTHORIZING CONTRACT WITH  MAJESTIC OIL COMPANY FOR THE SUPPLY AND DELIVERY OF #2 HEATING OIL $2.4135 AS PER PD#010-018 FOR THE PERIOD OF TWO YEARS BEGINNING FROM THE DATE OF THE AWARD.  Haynes moved and Hamilton seconded to adopt R. #158.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     R. #154.10:  RESOLUTION PROVIDING FOR THE RENEWAL OF A PLENARY RETAIL CONSUMPTION LICENSE #0814-33-016-010 PPN INVESTMENT CORPORATION T/A ROCKING STONE IRISH PUB & GRILL.

 

     Mayor Burzichelli stated the above item is held until the Solicitor clears up a few matters.

 

     INTRODUCTION AND FIRST READING:

 

     O. #10.10:  AMENDED AND RESTATED BOND ORDINANCE      AUTHORIZING IMPROVEMENTS TO THE WATER TREATEMENT      SYSTEM IN THE BOROUGH OF PAULSBORO, COUNTY OF GLOUCESTER, NEW JERSEY; APPROPRIATING THE SUM OF      $6,167.000 THEREFOR; AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION BONDS OR BOND ANTICIPATION NOTES OF THE BOROUGH OF PAULSBORO, COUNTY OF GLOUCESTER, NEW JERSEY, IN THE AGGREGATE PRINCIPAL AMOUNT OF UP TO $6,167,000 MAKING CERTAIN DETERMINATIONS AND COVENANTS; AND AUTHORIZING CERTAIN RELATED ACTIONS IN CONNECTION WITH THE FOREGOING.  Haynes moved and Hamilton seconded to adopt O. #10.10 on introduction and first reading and schedule the second reading and public hearing on October 5, 2010.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     Letter of recommendation from Chief Grogan regarding the Riverside Inn.   

 

     Mayor Burzichelli stated this matter was to be held until all aspects of the application have been received.

 

     Solicitor DeTitto reported on the Open Public Meetings Act Seminar that was sponsored by the County.  She made a few recommendations such as when the Governing Body resumes from closed session to have the Mayor make a statement as to what was discussed in the closed session and before Council receives any public comments to make a motion to open the meeting  and make another motion when Council finishes the open portion.  She will also prepare a summary of the Open Public Meetings Act.

 

     Councilman Kidd questioned if there were any other elected officials at the Seminar as Council wasn’t asked to attend.

 

     Solicitor DeTitto stated she didn’t see any that she recognized but maybe in the future there will be another seminar for the elected officials.

 

     Mayor and Council discussed the correspondence regarding Hubbs v. Paulsboro.  Administrator Salvatore stated Council has to appoint legal counsel to represent the Borough.

 

     Mayor Burzichelli stated a few more questions had to be answered.

 

     Mayor and Council discussed the correspondence from Wayne and Linda Pilger requesting purchasing part of the land next to their property.

 

     Administrator Salvatore stated it could get very expensive due to the Engineering and Legal costs.

 

     Solicitor DeTitto stated the Borough would have to offer the property to any adjoining owners, a title would have to be transferred, a legal description would have to be prepared and then it would have to go before the Land Use Board.

 

     Mayor Burzichelli suggested Solicitor DeTitto prepare the process and turn this over to the Public Property Committee for review.

 

     Administrator Salvatore suggested getting legal costs from the Solicitor’s Office once the process comes back to the Council.

 

     Councilman Giovannitti discussed the bus stops.  He stated there were issues at the former locations.  He met with the Bus Company and reduced the bus stops due to the quality of life the residents were experiencing.  The Bus Company didn’t think the Borough needed seven (7) stops.  He suggested having one location near the old Verizon Building on the corner of Paul Avenue and Broad Street.

 

     There was discussion regarding providing trash cans at the bus stops.

 

     Mayor Burzichelli stated when the Borough sends a copy of the Resolution to also ask New Jersey Transit to hang trash cans off of their bus stop signs.

 

     R. #159.10:  RESOLUTION OF THE BOROUGH OF PAULSBORO DESIGNATING BUS STOP LOCATIONS ALONG STATE HIGHWAY ROUTE 44 IN THE BOROUGH OF PAULSBORO.   Giovannitti moved and Hamilton seconded to adopt R. #159.10 and notify NJ Transit to place trash cans on their signs.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Morina, Tedeski.  Nays:  Kidd.  Motion carried.

 

     Councilman Giovannitti thanked Council for their feedback in regards to the bus stops.

 

     Councilman Giovannitti stated he is working on park procedures.  He asked Council to come up with some ideas.  He has a rough copy of a draft application to give to Council.

 

     Lieutenant Chris Wachter stated from August 26th to September 10th the Police Department held “over the limit, under arrest” checkpoints.  They had three DWI arrests and gave out 33 motor vehicle violations.

 

     Lieutenant Wachter stated the Police Department had a special assignment through overtime on the streets of Spruce and Washington Streets regarding loitering, curfew etc.  After 10:00 p.m., they caught 37 juveniles past curfew and he felt it was very successful.  He further stated the violent crime rate has gone down from last year’s summer.

 

     Lieutenant Wachter stated Council will start to see the new SLEO more and more and he is currently doing radar training.

 

     Lieutenant Wachter stated the Police Department has received final approval to spend the Buffer Zone and JAG grant monies.  They will purchase better radios, the License Plate Recognition System and the electronic sign.

 

     There was some discussion regarding the new radios and the interference.

 

     Councilman Morina discussed the curfew and the fact that football doesn’t get over until 11:00 p.m. on Friday nights.  He was concerned and felt the games should start earlier or have a designated walking route after football lets out.

 

     Councilman Kidd discussed his concern in regards to the traffic at Billingsport School when the children are leaving which is in part to parents picking up their children.  He felt someone is going to get hurt.

 

    There wasn’t any further Borough business.

 

     Haynes moved and Hamilton seconded to adjourn the meeting at 5:56 p.m.  All were in favor of the motion.
