REGULAR MEETING

 

Council Chamber:

 

     Mayor Burzichelli presided at the Regular Meeting of Council held on the above date and place.

 

     Mayor Burzichelli called the meeting to order.

 

     Mayor Burzichelli recited “Harry Truman’s Prayer as the opening prayer.

 

     Mayor Burzichelli asked all those present to join in the salute to the flag, which was conducted by Borough Clerk VanScoy.

 

     Borough Clerk VanScoy read the opening statement regarding the Open Public Meetings Act.

 

     Members present were: Haynes, Giovannitti, Hamilton, Kidd, Tedeski.  Absent:  Morina.

 

     Mayor Burzichelli presented a proclamation to Benjamin W. Redrow who has attained the rank of Eagle Scout.

 

     Benjamin Redrow thanked everyone who supported him and assisted him with his Eagle Scout project.

 

     Mayor Burzichelli opened the floor to the public.

 

     Barry Corradetti, 1820 Overbrook Avenue, congratulated Councilmen Hamilton and Giovannitti.  He commended Lisa Lozada-Shaw for “throwing her hat into the ring” and he was proud of her as it is not easy.  He questioned if Mayor and Council considered having political debates during an election.

 

     Mayor Burzichelli stated it is not a local governmental function but that the Neighborhood Watch Association could hold a forum and invite the candidates.

 

     Joyceline Gaines, 231 West Washington Street, thanked Council for getting the bus stop at Paul Avenue in front of the Verizon building.  The sign has been there but the bus drivers haven’t been notified of the stop.

 

     Mayor Burzichelli thanked Councilmen Hamilton and Giovannitti who was behind the placement of the bus stop.

 

     There wasn’t any further public participation.

 

     R. #171.10:  RESOLUTION PROVIDING FOR THE PAYMENT OF THE BILLS OUT OF THE 2010 BUDGET.  Haynes moved and Hamilton seconded to pay all bills properly signed and adopt R. #171.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Tedeski.  Nays:  None.  Motion carried.

 

     R. #172.10:  RESOLUTION OF THE BOROUGH OF PAULSBORO      AUTHORIZING A REFUND FOR AN OVERPAYMENT OF TAXES ON THE PROPERTY KNOWN AS BLOCK 69, LOT 3.  Haynes moved and Hamilton seconded to adopt R. #172.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Tedeski. Nays:  None.  Motion carried.

 

     R. #173.10:  RESOLUTION PROVIDING FOR THE INSERTION OF A SPECIAL ITEM OF REVENUE IN THE BUDGET IN THE BOROUGH OF PAULSBORO, COUNTY OF GLOUCESTER AND STATE OF NEW JERSEY PURSUANT TO N.J.S. 40A:4-87 (CHAPTER 159, P.L. 1948).  Haynes moved and Hamilton seconded to adopt R. #173.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Tedeski.  Nays:  None.  Motion carried.

 

     R. #174.10:  RESOLUTION PROVIDING FOR THE INSERTION OF A SPECIAL ITEM OF REVENUE IN THE BUDGET IN THE BOROUGH OF PAULSBORO, COUNTY OF GLOUCESTER AND STATE OF NEW JERSEY PURSUANT TO N.J.S. 40A:4-87 (CHAPTER 159, P.L. 1948).  Haynes moved and Hamilton seconded to adopt R. #174.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Tedeski.  Nays:  None.  Motion carried.

 

     R. #175.10:  RESOLUTION PROVIDING FOR THE INSERTION OF       A SPECIAL ITEM OF REVENUE IN THE BUDGET IN THE BOROUGH OF PAULSBORO, COUNTY OF GLOUCESTER AND STATE OF NEW JERSEY PURSUANT TO N.J.S. 40A:4-87 (CHAPTER 159, P.L. 1948).  Haynes moved and Hamilton seconded to adopt R. #175.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Tedeski.  Nays:  None.  Motion carried.

 

     R. #176.10:  RESOLUTION PROVIDING FOR ALLOWANCE OF A WIDOW OF VETERAN DEDUCTION.  

 

     R. #177.10:  RESOLUTION PROVIDING FOR THE CANCELLATION OF CERTAIN BALANCES ON WATER AND SEWER ACCOUNTS. 

 

     R. #178.10:  RESOLUTION PROVIDING FOR THE CANCELLATION OF CERTAIN BALANCES ON WATER AND SEWER ACCOUNTS. 

 

     Haynes moved and Hamilton seconded to adopt R. #176.10, #177.10 and #178.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Tedeski.  Nays:  None.  Motion carried.

 

     R. #166.10:  RESOLUTION OF THE BOROUGH OF PAULSBORO PROVIDING FOR THE APPROVAL OF A PERSON-TO-PERSON TRANSFER OF A PLENARY RETAIL CONSUMPTION LICENSE #0814-33-008-010 NOW HELD BY DONALD M. PENNY T/A RIVERFRONT PUB TO OWEN C. HAYNES, SR. T/A RIVERSIDE INN.

 

     Council President Haynes abstained from this matter for cause.

 

     Mayor Burzichelli stated conditions are being placed upon the Resolution and they are as follows:

 

1.    Licensee shall construct a barrier/fence along the property line separating the licensed premises from 33 Riverview Avenue.  The fence shall be a sufficiently secure barrier to prevent pedestrian and vehicular traffic.  Said barrier/fence shall be constructed within ninety (90) days from the date of memorialization of this Resolution.

 

2.    Licensee shall construct a barrier/fence in the backyard of the building from the northwest corner of the structure northward to the existing riverfront fence.  Said barrier/fence shall not be less than six (6) feet in height.  Said barrier/fence shall be constructed within thirty (30) days from the date of memorialization of this resolution.

 

3.    No alcohol shall be served, consumed or in open view on the outside of the licensed structure with the exception of the fenced backyard and the fenced eastside yard.

 

4.    No alcohol shall be served, consumed or in open view on the front step, entranceway, front sidewalk, parking lot or the Westside yard.

 

5.    The hours of alcohol service and consumption in the north and eastside yard shall be restricted to Sunday through Thursday until 10:00 p.m. and Friday and Saturday until 12:00 a.m.

       

     Kidd moved and Hamilton seconded to adopt R. #166.10 with the above conditions.  Roll call:  Ayes:  Giovannitti, Hamilton, Kidd, Tedeski.  Nays:  None.  Abstained:  Haynes for cause.  Motion carried.

 

     Summary of reports and copies of minutes of meetings.  Haynes moved and Hamilton seconded to receive and file.  All were in favor of the motion.

 

     O. #11.10:  BOND ORDINANCE AUTHORIZING THE CONSTRUCTION OF AN ELEVATED WATER TANK IN AND OR THE BOROUGH OF PAULSBORO, COUNTY OF GLOUCESTER, NEW JERSEY; APPROPRIATING THE SUM OF $2,100,000 THEREFOR; AUTHORIZING THE ISSUANCE OF GENERAL OBLIGATION BONDS OR BOND ANTICIPATION NOTES OF THE BOROUGH OF PAULSBORO, COUNTY OF GLOUCESTER, NEW JERSEY IN THE AGGREGATE PRINCIPAL AMOUNT OF UP TO $2,100,000; MAKING CERTAIN DETERMINATIONS AND COVENANTS; AND AUTHORIZING CERTAIN RELATED ACTIONS  IN CONNECTION WITH THE FOREGOING.  Haynes moved and Hamilton seconded to adopt O. #11.10 on Introduction and first reading and schedule the second reading and public hearing on November 15, 2010.   Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Tedeski.  Nays:  None.  Motion carried.

 

     O. #12.10:  AN ORDINANCE TO FURTHER AMEND AND SUPPLEMENT SALARY ORDINANCE OF THE BOROUGH OF PAULSBORO.  Haynes moved and Hamilton seconded to adopt O. #12.10 on Introduction and first reading and schedule the second reading and public hearing on November 15, 2010.   Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Tedeski.  Nays:  None.  Motion carried.

 

     Letter from Anna Docimo, Gloucester County Division of Senior Services, requesting the shuttle bus for the annual Senior Citizen Christmas Party on Tuesday, December 7, 2010 from 11:00 a.m. to 3:00 p.m. at Auletto Caterers in Almonesson.  Haynes moved and Hamilton seconded to receive, file the letter, approve the request and notify the proper departments.  All were in favor of the motion.

 

     TRICO JIF Member Update – October 8, 2010.  Haynes moved and Hamilton seconded to receive and file the update.  All were in favor of the motion.

 

     Memo from Marc Kamp regarding Yard Sale Ordinance.  Haynes moved and Hamilton seconded to receive, file the memo and turn this over to the Solicitor.  All were in favor of the motion.

 

     OLD BUSINESS:  There wasn’t any old business at this time.

 

     MAYOR AND COUNCIL REPORTS:

 

      Mayor Burzichelli discussed the Paul House project and that the Borough received a grant to do stabilization.  He recommended the award of a contract with Kimmel Bogrette as the Architect for this project.  The amount shall not exceed $15,000.

 

     R. #179.10:  RESOLUTION OF THE BOROUGH OF PAULSBORO APPOINTING KIMMEL BOGRETTE AS ARCHITECT FOR A SPECIAL PROJECT.  Haynes moved and Hamilton seconded to adopt

R. #179.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Tedeski.  Nays:  None.  Motion carried.

 

     At this time, 7:25 p.m., Mayor Burzichelli excused himself from the meeting as his mother is very sick and turned the meeting over to Council President Haynes.

 

      Before Mayor Burzichelli left, he congratulated Councilmen Hamilton and Giovannitti on their re-election.

 

     OLD BUSINESS:  There wasn’t any old business at this time. 

 

     MAYOR AND COUNCIL REPORTS:

 

     Councilman Kidd questioned the status of the fire alarm system because as of December 1, 2010 Valero will no longer be the owner of the refinery.

 

     Administrator Salvatore stated he did not know anything about it but to list it for the new Work Session Meeting.

 

     Councilman Kidd questioned what happened to the basketball nets on Elizabeth Avenue.  He spoke with the maintenance supervisor and was informed he did not know.  He asked to turn this matter over to the Police Department for investigation.

 

     Kidd moved and Hamilton seconded to turn the above matter over to the Police Department for review.  All were in favor of the motion.

 

     Councilman Kidd congratulated Councilmen Hamilton and Giovannitti on their re-election.

 

     Councilman Kidd asked for a moment of silence to pray for the Mayor’s mother.

 

     At this time, a moment of silence was held.

 

     Councilman Giovannitti gave an update regarding the flooding on Delaware Street.  The Street and Highway crew went out and trimmed the trees and raked leaves from the gutter.  The Water and Sewer Department borrowed a jet machine from Greenwich Township to clean out the lines.  He hoped this will help the problem with the flooding.

 

     Councilman Giovannitti thanked the residents in the community for their support during the election.

 

     Councilman Giovannitti stated last year elected officials were invited to a dinner and seminar through the JIF and the Borough received a $250.00 credit for each official.  He informed Council it will be held again this year.

 

     Councilman Giovannitti stated the position of Council person is a very difficult job and he takes it very seriously.

 

     Councilwoman Tedeski congratulated Councilmen Giovannitti and Hamilton on their re-election and thanked everyone who supported them.

 

     Councilwoman Tedeski stated she has spoke with Linda and Wayne Pilger about the parcel of land they would like to purchase from the Borough and asked that this item is placed on the next Work Session Meeting agenda.

 

     Councilwoman Tedeski stated the Holiday Parade will be held on December 4th at 6:00 p.m.  She further stated the Fire Department wanted to get more involved with more neighboring Fire Departments participating.

 

     Councilman Hamilton discussed a big traffic problem on Swedesboro Avenue.  There has been relief on behalf of the Paulsboro Police Department and they have put the speeding to a stop and people have been charged.

 

     Councilman Hamilton thanked everyone for helping with the election as it is not an easy job to be Councilman but he is grateful to be on Council.  He thanked Lisa Lozada-Shaw for her participation as a running opponent.  He further thanked the community for their support.

 

     Council President Haynes asked for the discussion regarding the issue fronting the Borough on the water meters to be placed on the next Work Session Meeting agenda and further asked for Erik Biermann from Sickels and Associates to be present.

 

     Council President Haynes thanked Councilmen Hamilton and Giovannitti for their dedication and thanked Lisa Lozada-Shaw for running and stepping up to run for election.  He further thanked the neighbors for coming to the meeting as it is good to have input from the residents.

 

     There wasn’t any further Borough business.

 

     Giovannitti moved and Hamilton seconded to adjourn the meeting at 7:37 p.m.  All were in favor of the motion.
