MINUTES OF LAND USE BOARD MEETI= NG

September 14, 2009

A regular meeting of the Land Use Board of the Borough of Paulsboro was calle= d to order by the Chairman, Wayne Wurtz, on Septembe= r 14, 2009 at approximately 7:00 p.m.

Open Public Meetings Act was read by John Alice, Esquire, Solicitor.

The Board saluted the flag with the Pledge of Allegiance

Roll Call: Members Present: Robert= DeAngelo, Allen Gray, Larry Haynes, Rita Kelly, James Salvatore, Alice Williams, and Wayne Wurtz.

Absent: John Burzichelli, Leon Manchester, James Scott,= James Sharper and Phil Zimm.

Also present: John Alice, Solicito= r, George Stevenson, Planner, Remington and Vernick, and Ma= rc Kamp, Zoning Officer

A motion was made by Rita Kelly seconded by James Salvatore to adopt the minu= tes from the meeting of July 6, 2009. Voice Vote: All= ayes in favor – no against – no abstentions.

An application was to be heard regarding James Scott for a fence permit for property known as 7 West B= uck Street, Block 86, Lot 13. The applicant had contact= ed the Zoning Office asking that the matter be continued to the next meeting agree= ing to waive any time limitations. A motion was made by Robert DeAngelo, seconded by= Rita Kelly to continue this application to the October 5, 2009 meeting, The so= licitor asked if we received this information in writing and Mr. Kamp advised that = he would contact Mr. Scott asking that he submit the request in writing.

A motion was made by Robert DeAngelo to amend the= previous motion to continue the application to the October meeting contingent upon M= r. Scott providing the request in writing and stating that he did waive all ti= me constraints. This motion was seconded by Larry Haynes.

George Stevenson, the Board’s Planner, of Remington and Vernick presented an overview of the 2006 Re-Examination of the Borough’s Mas= ter Plan which was adopted in December of 1998. The purpose of this review is to s= ee how problems and objectives have been addressed, discuss if there should be any changes to the goals and objectives, making recommendations to modification= s to the Master Plan. <= /o:p>

Mr. Stevenson indicated that he did make a presentation on this in 2006, however it was requested by the Board to allow t= ime to review the report and the act on it at a later date.

Mr. Stevenson indicated that there have been significant changes to the Borough with Redevelopment in several locations, specifically, the Port Development, Interchange 18, and other areas.

As to major problems and objectives, the Borough was looking at a serious decline= due to the shift in Petro-Chemical sites and a decline in Delaware Street. As to neighborhood preservation, a large percentage of older homes have had improvements. Properties have been acquired and demolished under the Redevelopment plan.

The creation of the marina industrial use was one way to address the shift from= the petro-chemical plants, coming up with an alternate commercial alternative. <= o:p>

As to the downtown commercial area, the 1998 Master Plan stated that you cannot h= ave a business on a bottom floor. This is incorrect and that needs to be addressed.

There are Third Round Rules in Affordable Housing to be implemented or the Plan amended to show a higher number of affordable housing.

The zoning for the area on Bro= ad Street from Elizabeth Avenue to Billingsport Road which is recommended to be CH (Commercial Highway) should be addressed for residences to become pre-existing non-conforming uses.

The State of New Jersey Department of Environmental Protection has implemented Stormwater Management regulations which should be dea= lt with.

The following recommendations should be reviewed:

a. Land = Use Elements – Due to several redevelopment studies and redevelopment are= as adopted the Master Plan should be amended to reflect those areas.

b. The Commercial Highway district should be revised to determine if single family detached units are appropriate on this area of Broad Street from Elizabeth Avenue to Billingsport Road.

c. The Housing Element of the Master Plan should be updated to reflect the Thi= rd Round Rules for Affordable Housing.

d. The M= aster Plan should be amended to add a Stormwater Mana= gement Plan to incorporate the Watershed Based Municipal Stor= mwater Mangement Plan.

e. The B= orough currently does not have an Open Space and Recreation Element. The Environmental Commission has received Grants and has contracted for an Environmental Resource Inventory = that will satisfy the Open Space and Recreation Element of the Master Plan.=

f. Zoning Ordinances should be amended to reflect the types of uses and bulk and area regulations in the Borough’s Commercial areas.

g. The Zoning Map should be amended to reflect the areas that have been design= ated as Redevelopment Areas.

h. The standards for parking, loading, buffering, landscaping, lighting, signage, street design, storm drainage, utilities, grading, soil erosion and sedimentation control, open space and recreation, and blocks and lots be amended as well as a new application checklist developed.

These points were discussed by the Board with Mr. Stevenson and Mr. Stevenson will draft something to reflect the requested changes and arrange to discuss thi= s at the next meeting.

As to correspondence, there are make up seminars being held for Board members, however, all of the members have met the requirement of attendance at a Land Use Seminar.

There being no further business, a motion was made by Rita Kelly, seconded by James Salvatore= , to adjourn the meeting. The meeting was adjourned at approximately 8:50 p.m.
