MINUTES OF LAND USE BOARD MEETI= NG

March 1, 2010=

Call to Order – Open Publ= ic Meetings Act – Roll Call :

John Alice, Solicitor, swore in Phil Zimm for his te= rm.

The Regular meeting of the Land Use Board of the Borough of Paulsboro was called to ord= er by the Solicitor, John Alice, on March 1, 2010 at approximately 7:00 p.m.

Robert DeAngelo was named as acting Chairman due to the absence of Wayne Wurtz, Chairman and Leon Manch= ester, Vice-Chairman.

Open Public Meetings Act was read by John Alice, Esquire, Solicitor.

The Board saluted the flag with the Pledge of Allegiance

Roll Call: Members Present: John Burzichelli, Robert DeAngelo, Allen Gray, Inez Nelson, James Scott, Alice Williams, and Phil Zimm.

Absent: Larry Haynes, Rita Kelly, Leon Manchester, James Salvatore, James Sharper a= nd Wayne Wurtz.

Also present: John Alice, Solicito= r; Charles Chelotti, PE, Board’s Engineer; and Marc = Kamp, Zoning Officer.

&n= bsp; A motion was made by James Scott, seconded by Inez Nelson to approve the minu= tes of the meeting of January 11, 2010. (There was no February 2010 meeting= .)

Simply Hotels, LLC – Bloc= k 124, Lot 5 – Lodge Avenue App. No. ASP-01-10 – = Final Major Site Plan – Amended

An application was submitted by Simply Hotels, LLC – App. No. ASP-01-10 for Amended Final Major Site Plan. Joseph Maress= a, Jr., Esquire represented Simply Hotels, LLC. and Timothy Kernan, Engineer for the Applicant and = Mitel Chheda, Representat= ive of Simply Hotels were sworn in.

Mr. Maressa provided an overview of the project as follow= s:

1. This project was previously approv= ed as a three story project and the hotel would be Comfort Inn – however, Marriott Hotels has agreed to take over the project and the hotel would be a Fairfield Inn. The main chang= e would be from a three story hotel to a four story hotel and the exterior color wo= uld change as well.

2. The number of rooms would stay the= same, however the “footprint” of the building would be smaller as the= re will be an additional floor.

Mr. Kernan – Project Engineer, testified as follows= :

1. He was the Project Engineer when o= riginally presented as Phase One.

2. The parking count in the parking l= ot will stay the same.

3. The footprint will be smaller due = to building going from three floors to four.

4. The signage will comply with the B= oard Engineer’s recommendations. The current plan calls for a sign on the front of the building at the entrance and at the back corner. The proposed signage will be well within the initial approval and th= ey are willing to work with the Board’s Engineer to get this project moving.=

5. The Marriott will not allow exteri= or lights on the building but they are willing to work with the Board’s Engineer regarding this.

The = Board had a question with respect to the free standing signs – this is one = of four approvals for this area and instead of four separate free standing sig= ns the Board requests that all the applicants get together and have one free standing sign or some kind of unified signage.

Mr. Kernan advised that the applicant is willing to work = with the Board and the other applicants regarding the pylon signage.<= /span>

Mr. Chheda stated that the Marriott will want signs on the building but he agrees to check with the other applicants as to the pylon signage. Mr. Chheda agreed to come back as to the status of the signage.

The = Board asked how soon they expect to start the project and Mr. Kernan responded that the Company wants to move as soon as possible, hopefully as = soon as the financing is in place and approved. The Company wants it sooner rather = than later.

A mo= tion was made by Phil Zimm, seconded by James Scott to o= pen the meeting to the public.

Barry Cordetti of 1820 Overbrook, Paulsboro, spoke and indicated that he is ok with the changes, most o= f his questions have been answered. He was concerned as to the landscaping and there being enough trees to protect= the property and privacy of the citizens.

He understands that there will be no lounge or restaurant at the hotel.

He had a question as to once the properties are all sold, who is responsible f= or the reservoir – basin. = He indicated that the weeds were high and he knows that originally the applica= nt was required to put bushes and trees between the reservoir and his property. Once this is develo= ped, who will be responsible for the upkeep and take care of the property.<= /o:p>

He was advised that this will be similar to a Homeowners Association where the owner will enter into an agreement and the trees and bushes will be planted= and maintained. There must be an agreement to this by the businesses. There is still one additional lot to be sold. At this point, Mr. Salerno is responsible for the upkeep.

Ther= e being no other questions or comments from the Public, a motio= n was made by Phil Zimm, seconded by Inez Nelson, to = close the meeting to the public.

A mo= tion was made by Phil Zimm, seconded by James Scott, to approve the amended site plan contingent upon the compliance with the comme= nts of the Board’s Engineer in the letter report and the Applicant’s Engineer following through and working with the Board’s Engineer as to lighting and a good faith effort to work up a cohesive signage plan.

Open to Public:

Ther= e were no members of the public in attendance wishing to speak or address the Boar= d.

As to Correspondence:

The secretary advised the Board of receiving and filing the following correspondence:

1. Report from NJDEP dated January, 2= 010, Waterfront Development, Flood Hazard Permit Application.<= /p>

2. NJDEP – Waterfront Developme= nt Permit dated January 15, 2010.

3. NuStar= – Waterfront Development Permit dated January 15, 2010.

4. Glorious Light Christian Ministries – letter from Remington and Vernick dated January 21, 2010 – regarding a site visit and compliance.<= /span>

5. Regarding = 448 W. Broad Street – letter = to Madden Madden and DelDuca<= /span> – violations and scheduling hearing with court.

Memorialization<= /span> of Resolution:

A Resolution regarding the minor site plan submitted by Classic Realty Holding= s, LLC for a minor site plan for property known as 416 West Broad Street, Block 97, Lot 2. was pre= sented for memorialization. A motion was made by James Scott, seconded by Inez Nelson to approve the Resolution. Roll Call Vote: In Favor, R. DeAngelo, A. Gray, I. Nelson, J. Scott and A. Williams; Against None; Abstain None.

Adjournment:

There being no further business, a motion was made by James Scott, seconded by In= ez Nelson, to adjourn the meeting. The meeting was adjourned at approximately 7:55 p.m.
