REGULAR MEETING

 

Council Chamber:

 

     Mayor Burzichelli presided at the Regular Meeting of Council held on the above date and place.

 

     Mayor Burzichelli called the meeting to order.

 

     Mayor Burzichelli recited “Harry Truman’s Prayer as the opening prayer.

 

     Mayor Burzichelli asked all those present to join in the salute to the flag, which was conducted by Borough Clerk VanScoy.

 

     Borough Clerk VanScoy read the opening statement regarding the Open Public Meetings Act.

 

     Members present were: Haynes, Giovannitti, Hamilton, Kidd, Morina, Tedeski.  Absent:  None.

 

     Mayor Burzichelli opened the floor to the public.

 

     Anthony Bennett, 20 East Buck Street, discussed the Recreation Committee and keeping the kids off the street during the summer months.  He presented a program at the YMCA.

 

    Mayor Burzichelli stated this program used to be coordinated through the Cub Scouts.  He stated the governing body is supportive but is limited.  He suggested Mr. Bennett coordinate this through the Boys and Girls Club and they may already have a deal with the YMCA.

 

     Joyce Gauthney, 1711 Dayton Avenue, discussed the construction being done at the Wawa site.  One of the machines has her house shaking and cracks are forming and it went on for one and a half days.  She called the Borough and she received a phone call back from Charles Chelotti.

 

     Mayor Burzichelli stated the Borough will have Mr. Chelotti come to her house as it would seem odd that the machines were doing this as that method and machine is common.

 

     Mrs. Gauthney would like a response in writing after Mr. Chelotti comes out.  She questioned if there was any way there could be sound/privacy barriers as people will be cutting through the lots.

 

     Mayor Burzichelli felt that it was addressed in their site plan.

 

     Chantel Williams, 1720 Dayton Avenue, discussed speed bumps or children playing signs.

 

     Mayor Burzichelli stated he would look into the signs.

 

     Joyceline Gaines, 231 West Washington Street, discussed a young lady walking down Washington Street carrying a book.  She was impressed and asked what her name was and she stated it Miss Hutchinson.  She then questioned how she was doing in school and was informed that she is getting A’s and B’s.  She told her to keep it up.  She felt she had to give her “kudos”.

 

     Ms. Gaines stated things have been an improvement since the Police Department hasn’t had to deal with 244 West Washington Street.

 

     Emma Hackley, 201 West Washington Street, stated there are large parties next door to her and she can’t stand the noise.  It is a small backyard but it is overflowing.  There are children around after 10:00 p.m. setting off fireworks and darting between cars.  She calls the Police; they respond and disperse the crowd.  She asked if the Police Department would keep an eye on that area.  The party started on Friday and lasted until Sunday.  She further stated that the children are getting on the corners and throwing a ball to the other side and then run across the street in front of traffic.

 

     Mayor Burzichelli read the noise ordinance and the Police Department does try to stop the children from playing “curb ball”.

 

     Mrs. Hackley suggested consolidating services to help keep the streets clean.

 

     Mayor Burzichelli stated her suggestion is a good idea and that the Borough was waiting on a new street sweeper.

 

     Marvin Hamilton, 913 North Chestnut Street, also discussed the children playing “street ball” and the cars race up and down the street.  The house across the street from him has kids playing there, knocking down the fence and the kids are nasty.  He is afraid someone is going to get hurt.

 

     Joyce Cooper, 123 Buck Street, stated that everything Mrs. Hackley says is true.  She is having problems with the kids playing in her field as they have hit her car and almost broke the windshield.  She has talked to the parents and almost got into it with one of the parents.  She questioned if she put up no trespassing signs in her field if they would be honored.

 

     Mayor Burzichelli stated it could help and to call the Police.

 

     Michael Licciardello, 520 Beacon Avenue, stated there has been a volunteer attending the Fire Academy by the name of Charles Shaw who finished highest in the Academics Award and he wished to recognize him.

 

     There wasn’t any further public participation.

 

     Minutes of a Work Session Meeting held on May 17, 2010 at 5:00 p.m.  Haynes moved and Hamilton seconded to receive, file and adopt the above minutes.  All were in favor of the motion.

 

     R. #90.10:  RESOLUTION PROVIDING FOR THE PAYMENT OF THE BILLS OUT OF THE 2010 TEMPORARY BUDGET.  Haynes moved and Hamilton seconded to pay all bills properly signed and adopt R. #90.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     R. #91.10:  RESOLUTION PROVIDING FOR CHANGE ORDER NO. 3 IN CONNECTION WITH THE RECONSTRUCTION OF BILLINGS AVENUE - PHASE I & PHASE 11 IN THE BOROUGH OF PAULSBORO.  Haynes moved and Hamilton seconded to adopt R. #91.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     R. #92.10:  RESOLUTION PROVIDING FOR ALLOWANCE OF A SENIOR CITIZEN DEDUCTION. 

 

     R. #93.10:  RESOLUTION PROVIDING FOR THE CANCELLATION OF CERTAIN BALANCES ON WATER AND SEWER ACCOUNTS. 

 

     R. #94.10:  RESOLUTION PROVIDING FOR THE CANCELLATION OF CERTAIN BALANCES ON WATER AND SEWER ACCOUNTS. 

 

     R. #95.10:  RESOLUTION PROVIDING FOR ALLOWANCE OF A VETERAN DEDUCTION. 

 

     R. #96.10:  RESOLUTION PROVIDING FOR THE CANCELLATION OF CERTAIN BALANCES ON WATER AND SEWER ACCOUNTS. 

 

     Haynes moved and Hamilton seconded to adopt R. #92.10, #93.10, #94.10, #95.10 and #96.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     R. #97.10:  RESOLUTION OF THE BOUROUGH OF PAULSBORO AUTHORIZING THE BOROUGH OF PAULSBORO TO ESTABLISH A FEE SCHEDULE ASSOCIATED WITH MUNICIPAL WORK ON PRIVATE PROPERTIES.  Haynes moved and Hamilton seconded to adopt R. #97.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     Summary of reports and copies of minutes of meetings.  Haynes moved and Hamilton seconded to receive and file.  All were in favor of the motion.

 

     SECOND READING AND PUBLIC HEARING:

 

     O. #08.10:  CALENDAR YEAR 2010 ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK (N.J.S.A. 40A: 4-45.14).  Haynes moved and Hamilton seconded to open the meeting to the public.  All were in favor of the motion.

 

     Barry Corradetti, 1820 Overbrook Avenue, questioned if this was in reference to Governor Christie’s proposal for a 2.5 % CAP.

 

     Mayor Burzichelli stated this is not related to that proposal and what the Governor is talking about hasn’t happened yet although the Borough is way under the CAP but it is something the Borough has to adopt.

 

     There wasn’t any other public participation.

 

     Haynes moved and Hamilton seconded to close the meeting to the public.  All were in favor of the motion.

 

     Haynes moved and Hamilton seconded to adopt O. #08.10 on second and final reading.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     Receipt of Bids:  Paulsboro Streetscape Phase II – Broad & Delaware Streets:

     Administrator Salvatore stated the recommendation is to award to Lexa Concrete as the first lowest bidder was missing information in the bid package.

 

     Haynes moved and Hamilton seconded to receive, accept, file and spread the bids in the minutes.  All were in favor of the motion.

 

     Letter from Anthony LaRosa, Birdsall Services Group, regarding Bid Review and Award Recommendation. 

 

     Letter from Maria DeTitto, Esq., Angelini, Viniar & Freedman, regarding Streetscape Project. 

 

     Haynes moved and Hamilton seconded to receive, file both letters.  All were in favor of the motion.

 

     R. #98.10:  RESOLUTION AWARDING CONTRACT FOR THE PAULSBORO STREETSCAPE PHASE II – BROAD AND DELAWARE STREETS IN THE BOROUGH OF PAULSBORO.  Haynes moved and Hamilton seconded to adopt R. #98.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     Receipt of Requests For Proposals – Professional Services for the Water Tower   Project:

     Administrator Salvatore stated these RFP’s would be received but they are still being reviewed.    

 

     Haynes moved and Hamilton seconded to receive, accept, file and spread the RFP’s in the minutes.  All were in favor of the motion.

 

     Administrator Salvatore stated, at this time, Mayor and Council has to adopt a Resolution regarding the 2010 Budget.

 

     R. #99.10:  RESOLUTION AUTHORIZING THE ALTERNATE METHOD OF COMPUTING THE RESERVE FOR UNCOLLECTED TAXES IN THE MUNICIPAL BUDGET OF THE BOROUGH OF PAULSBORO, COUNTY OF GLOUCESTER PURSUANT TO NJSA 40A:4-41 (c)(2).  Haynes moved and Hamilton seconded to adopt R. #99.10.  Roll call:  Ayes  Haynes, Giovannitti, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     INTRODUCTION OF THE 2010 BUDGET:

    

     R. #100.10:  2010 BUDGET.  Haynes moved and Hamilton seconded to adopt

R. #100.10 on Introduction and schedule the public hearing on July 6, 2010 at 7:00 p.m.  Roll call:  Ayes:  Haynes, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     Mayor Burzichelli stated this version of the budget is not final but at this time it is a $2.02 local tax levy.  He explained that the Borough is looking at a 16 cent tax rate but that it is not done yet.  He asked everyone to join Council on July 6th as it may be reduced.  Council is going to work to get it down further.  The Borough is spending $300,000 less than last year.

 

     Memo from Carolyn Zumpino, Triad Associates, regarding Request for Qualifications for Water Tower Design – Status Update.  Haynes moved and Hamilton seconded to receive and file the memo.  All were in favor of the motion.

 

     Memo from Michael Zumpino, Triad Associates, regarding the Water Project.    Haynes moved and Hamilton seconded to receive and file the letter.  All were in favor of the motion.

 

     Letter from Barry J. Corradetti, Paulsboro Neighborhood Watch Association, Inc., requesting the use of Fort Billings Park for the National Night Out Event to be held on Tuesday, August 3, 2010 from 6:00 p.m. to dusk.  Haynes moved and Hamilton seconded to receive, file the letter, approve the request and notify the proper departments.  All were in favor of the motion.

 

     Gloucester, Salem, Cumberland Counties Municipal Joint Insurance Fund Loss   Control Report.  Haynes moved and Hamilton seconded to receive and file the report.  All were in favor of the motion.

 

     Received Amusement Games Application from the Alibi Inn (All inspections have been performed.)  Haynes moved and Hamilton seconded to receive, file the application and approve the amusement games licenses.  All were in favor of the motion.

 

     Received Raffles License Application from the Loyal Order of Moose #2585 Woodbury Lodge for Instant Raffles.  Kidd moved and Hamilton seconded to receive, file the Raffles Application and approve the Raffles License.  All were in favor of the motion except Haynes abstained. 

 

     Memo from Chief F. Grogan regarding FY09 Buffer Zone Protection Program Award.  Haynes moved and Hamilton seconded to receive, file the memo and authorize the Mayor to execute.  All were in favor of the motion.

 

     Mayor Burzichelli explained that the Borough is receiving $85,000 from Homeland Security.

 

     Chief Grogan further explained that the grant monies would go towards equipment such as equipment that will monitor the traffic around the Valero Refinery, replacement of portable radios, commercial lighting (big sign) and a large generator.

 

     R. #101.10:  RESOLUTION PROVIDING FOR AN EXECUTIVE SESSION OF THE BOROUGH OF PAULSBORO.  Haynes moved and Hamilton seconded to adopt R. #101.10.  Roll call   Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

     This closed session was scheduled to discuss a personnel matter (Police Department).

 

     MAYOR AND COUNCIL REPORTS:

 

     Councilwoman Tedeski stated the Crime Free Housing Committee Meeting was held to try to “brainstorm” how to curb code, landlord and housing issues.

 

     Councilwoman Tedeski stated there will not be any summer concerts in the park and the 4th of July Parade will be held on July 3rd.

 

     Councilman Morina stated the Crime Free Housing Committee is doing a fine job.  He asked the public if the was any bad properties such as nuisance, grass overgrown, etc. to forward it to them.

 

     Councilman Morina left the meeting at 8:02 p.m.

 

     Councilman Giovannitti stated the street sweeper is down but the public may see one from the County.

 

     Councilman Kidd suggested sending a letter to Conrail thanking them for holding the train until the Memorial Day Service was over.

 

     Councilman Kidd requested to send a notice to everyone who has a budget to make recommendations for any cuts.

 

     Councilman Kidd discussed getting recreation committee members.  He further agreed with Mr. Bennett about having to do something with the youths.  This is why the Recreation Committee is important and he feels the Borough is falling short on the youth.  He also thanked everyone for coming to the meeting.

 

     Councilman Hamilton stated he did not have a report at this time.

     Council President Haynes stated he didn’t have a report as well but he has driven through Spruce and Washington Streets and the action is kind of out of hand.  The people are hanging in the lot and he asked the Police Department to keep an eye on it.

 

     Mayor Burzichelli discussed the 2010 Budget.  The cuts will be made to the overtime budget, no raises for the Governing Body or employees and the Borough is trying not to layoff employees as well as keep essential services.

 

     Haynes moved and Hamilton seconded to commence in Executive Session at 8:12 p.m.  All were in favor of the motion.

 

    

     Mayor and Council convened in Executive Session to discuss personnel and potential disciplinary litigation.

 

     Giovannitti moved and Hamilton seconded to open the meeting to the public at 8:37 p.m.  All were in favor of the motion.

 

     R. #102.10:  RESOLUTION APPOINTING A LAW ENFORCEMENT HEARING OFFICER FOR THE BOROUGH OF PAULSBORO.  Haynes moved and Hamilton seconded to adopt R. #102.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     R. #103.20:  RESOLUTION APPPOINTING A LAW ENFORCEMENT LABOR COUNSEL.  Haynes moved and Hamilton seconded to adopt R. #103.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     There wasn’t any further Borough business at this time.

 

     Haynes moved and Hamilton seconded to adjourn the meeting at 8:40 p.m.  All were in favor of the motion.
