REGULAR MEETING

 

Council Chamber:

 

     Mayor Burzichelli presided at the regular meeting of Council held on the above date and place.

 

     Borough Clerk VanScoy read the opening statement regarding the Open Public Meetings Act.

 

     Mayor Burzichelli recited “Harry Truman’s Prayer” as the opening prayer.

 

     Mayor Burzichelli asked all those present to join in the salute to the flag led by Borough Clerk VanScoy.

 

     Mayor Burzichelli called the meeting to order.

 

     Members present were: Haynes, Giovannitti, Hamilton, Kidd.  Absent:  Morina and Tedeski (excused for a family matter).

 

     Mayor Burzichelli opened the floor to the public.

 

     George Gallenthin, stated his family is from Paulsboro, he has real estate and a business in Paulsboro, discussed the Port of Paulsboro. He didn’t want any feedback or response to his statements.  He discussed the access road and railroad turnout, bidding requirements, BP in Wyoming and Wyoming DEP, sponsors for the port and ownership of the port.

 

     Jerome Beverly, 424 West Buck Street, discussed the playground atrocities.  He stated the playgrounds were supposed to get mulch in the last three years.  Nothing has been done to the Buck Street playground in over five years or any of the other parks.

 

     Mayor Burzichelli stated he is aware the Fort Billings Park was in need of mulch.

 

     George Gallenthin stated he can give mulch.

 

     There wasn’t any further public participation.

     Haynes moved and Hamilton seconded to receive, file and approve the above minutes.  All were in favor of the motion.

 

     R. #109.07:  EMERGENCY TEMPORARY RESOLUTION PRIOR       TO ADOPTION OF THE BUDGET.  Haynes moved and Hamilton seconded to adopt R. #109.07.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd.  Nays:  None.  Motion carried.

 

     R. #110.07:  RESOLUTION PROVIDING FOR THE PAYMENT OF        THE BILLS OUT OF THE 2007 TEMPORARY BUDGET.  Haynes moved and Hamilton seconded to pay all bills properly signed and adopt

R. #110.07.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd.  Nays:  None.  Motion carried.

 

     R. #111.07 RESOLUTION APPROVING THE OPENING OF A     BANK ACCOUNT FOR DONATIONS – COMMUNITY EVENTS IN        THE BOROUGH OF PAULSBORO.  Haynes moved and Hamilton seconded to adopt R. #111.07.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd.  Nays:  None.  Motion carried.

 

     Summary of reports and copies of minutes of meetings.  Haynes moved and Hamilton seconded to receive and file.  All were in favor of the motion.

 

     SECOND READING AND PUBLIC HEARING:

 

      O. #04.07:  CALENDAR YEAR 2007 – ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO       ESTABLISH A CAP BANK (N.J.S.A. 40A:4-45.14).  Haynes moved and Hamilton seconded to open the meeting to the public.  All were in favor of the motion.

 

     There wasn’t any public participation.

 

     Haynes moved and Hamilton seconded to close the meeting to the public.  All were in favor of the motion.

 

       Haynes moved and Hamilton seconded to adopt O. #04.07 on second and final reading.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton.  Nays:   Kidd.

 

     Mayor Burzichelli held the rest of the vote until either Councilwoman Tedeski and/or Councilman Morina could be reached by telephone for their vote (as per Solicitor Pierson).

 

     Letter from William G. Dressel, Jr., New Jersey State League of Municipalities, regarding Affordable Housing, Regional Contribution Agreements.  Haynes moved and Hamilton seconded to receive and file the letter.  All were in favor of the motion.

 

     Letter from William G. Dressel, Jr., New Jersey State League of        Municipalities, regarding A-4393 Projected Contract Cost Estimates.        Haynes moved and Hamilton seconded to receive and file the letter.  All were in favor of the motion.

 

     Letter from Barker Hamill, State of New Jersey, Department of Environmental Protection, Division of Water Supply – Bureau of Safe  Drinking Water, regarding Stage 2 Disinfectants and Disinfection Byproduct Rule.  Haynes moved and Hamilton seconded to receive, file the letter and have a meeting with the Water and Sewer Department.  All were in favor of the motion.

 

     Received Raffle License Application, RA #513, George D. Patton, Veterans of Foreign Wars Post 678 for their annual Instant Raffles.  Haynes moved and Hamilton seconded to receive, file the application and approve the above Raffle License.  All were in favor of the motion.

 

     Letter from Janet V. Byrd, Catherine J. Walker Temple No. 353, requesting permission to hold their annual Block Party for the Children of the Community on Sunday August 26, 2007 from 4:00 – 8:00 p.m.  They would like the Buck Street side of the Elks Home blocked off from Penn Line Street down to the back Entrance of the CVS Lot.  Haynes moved and Hamilton seconded to receive, file the letter, approve their request and notify the proper departments.  All were in favor of the motion.

 

     Letter from Glenn D. Roemmich, E.M. Coordinator, regarding National Incident Management System (NIMS).  Haynes moved and Hamilton seconded to receive and file the letter.  All were in favor of the motion.

 

       R. #112.07:  RESOLUTION DESIGNATING THE NATIONAL       INCIDENT MANAGEMENT SYSTEM (NIMS) AS THE BASIS FOR       ALL INCIDENT MANAGEMENT IN THE BOROUGH OF PAULSBORO.  Haynes moved and Hamilton seconded to adopt R. #111.07.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd.   Nays:  None.  Motion carried.

 

     Letter from Eileen Brennen, RCA Coordinator, State of New Jersey, Council on Affordable Housing, regarding RCA Administrator.  Sample Ordinance attached.  Haynes moved and Hamilton seconded to receive and file the letter.  All were in favor of the motion.

 

INTRODUCTION AND FIRST READING:

 

O. #06.07:  AN ORDINANCE TO CREATE THE POSITION OF MUNICIPAL HOUSING LIAISON (MHL)/RCA ADMINISTRATOR FOR THE PURPOSE OF ADMINISTERING THE BOROUGH OF PAULSBORO’S AFFORDABLE HOUSING PROGRAM AND REGIONAL CONTRIBUTION AGREEMENTS PURSUANT TO THE FAIR HOUSING ACT.  Haynes moved and Hamilton seconded to adopt

O. #05.07 on introduction and first reading and schedule the second reading and public hearing on July 17, 2007.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton.  Nays:  None.  Abstained:  Kidd.

 

    Councilman Kidd questioned who would be placed in this position and if this was part of the COAH lawsuit.

 

     Mayor Burzichelli stated he will be nominating Marc Kamp.  He further stated this is required by COAH and independent of the lawsuit.

 

     Councilman Kidd stated that he would change his vote to an aye but that he is still against the RCA’s.

 

     Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd.  Nays:  None.  Motion carried.

 

    

 

     Letter from Whitney Marks Gill, American Tower Corporation, regarding   Site 306741/Paulsboro NJ 2-Communication Tower Renewal.  Haynes moved and Hamilton seconded to receive, file the letter and place this matter on the next Work Session Agenda.  All were in favor of the motion.

 

      OLD BUSINESS:

 

     There wasn’t any old business at this time.

 

     MAYOR AND COUNCIL REPORTS:

 

     Councilman Giovannitti welcomed everyone and invited everyone to the Fourth of July Parade and the concert in the park.

 

     Councilman Giovannitti stated all of Council received a report from Code Enforcement Officer Keith Hogle.

 

     Councilman Giovannitti thanked Water and Sewer Superintendent John Daly and Borough Foreman Charles Tinder for their help on getting the Fourth of July Parade ready.

 

     Councilman Kidd questioned if a formal house policy has been prepared for the emergency generator.

 

     Mayor Burzichelli stated he wasn’t sure but would follow up on the matter.

 

     Councilman Kidd stated when he read the minutes from the Code Strike Force Committee Meeting he noticed that the main bus stops had been moved.  He questioned when this was done.

 

     Councilman Giovannitti stated a resolution was adopted.

 

     Mayor Burzichelli stated to check the resolution and pick this matter up at the Work Session.

 

     Councilman Kidd further discussed the bus stops and the fact there isn’t anywhere for people to stand or sit to wait for the bus.

 

     Councilman Kidd discussed the sneakers that were hanging from the poles.  He called the Electric Company and the Cable Company and they said it wasn’t their wires.  He then called the telephone company and said they would remove the sneakers but didn’t know when they could do it.

 

     Councilman Hamilton thanked the residents for coming to the meeting and wished everyone a safe and Happy 4th of July.

 

     Council President Haynes invited the residents to the 4th of July Parade.

 

     Mayor Burzichelli stated that Councilwoman Tedeski would be participating in the meeting by way of telephone.

 

     Mayor Burzichelli also invited everyone to the 4th of July Parade.

 

     Mayor Burzichelli stated that the Wawa has received preliminary and final approvals at the Land Use Board Meeting.  

 

     Mayor Burzichelli gave an update on the Port of Paulsboro.  He stated the Borough went into a contract with South Jersey Port Corporation and they will be developing the port.  The overpass is being built by the Gloucester County Utilities Authority in contract with the New Jersey Department of Transportation.  The pre-scoping has already been done.  Pennoni and Associates will be designing the overpass.

 

     Mayor Burzichelli stated at this time the vote would be taken on

O. #04.07.

 

     Solicitor Pierson stated for the record the vote was kept open.

 

     Mayor Burzichelli stated to let the record reflect that Councilwoman Tedeski has joined the meeting by way of telephone speaker.

 

     SECOND READING AND PUBLIC HEARING:

 

      O. #04.07:  CALENDAR YEAR 2007 – ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO       ESTABLISH A CAP BANK (N.J.S.A. 40A:4-45.14).

 

     Councilwoman Tedeski voted aye on adopt of O. #05.07.

 

     Roll call showed:  Ayes:  Haynes, Giovannitti, Hamilton, Tedeski.  Nays:  Kidd.  Motion carried.

 

     There wasn’t any further Borough business.

 

     Giovannitti moved and Hamilton seconded to adjourn the meeting at 7:40 p.m.  All were in favor of the motion.
