SPECIAL MEETING

 

Council Chamber:

 

     Mayor Burzichelli presided at the Special Meeting of Council held on the above date and place.

 

     Borough Clerk VanScoy read the opening statement regarding the Open Public Meetings Act.

 

     Members present were:  Haynes, Giovannitti, Hamilton, Kidd, Morina, Tedeski.  Absent:   None.

 

     Mayor Burzichelli opened the floor to the public.

 

     There wasn’t any public participation.

 

     Mayor Burzichelli stated this Special Meeting was called to hold the Landlord Licensing Hearing of Walter Justice at 244 West Washington Street.

 

     Solicitor Pierson introduced himself for the record and stated the hearing was called due to the administrative action of Keith Hogle.  He further presented testimony that due notice was given to Mr. Justice.  This hearing has been rescheduled from December 16, 2008 in order for Mr. Justice to obtain legal counsel. 

 

     At 5:13 p.m., Mr. Justice has not appeared.  Solicitor Pierson spoke with Mr. Justice today and Mr. Justice indicated to him that he would not be appearing.  Mr. Justice also informed Solicitor Pierson that he would be filing a deed at the County transferring the property to his Mortgage Company (GMAC) without the knowledge or consent from GMAC. 

 

     Solicitor Pierson called his first witness and swore in Keith Hogle, Landlord Licensing Inspector, to give testimony as to Exhibit P-4 which was a summons.

 

    

     Solicitor Pierson called his second witness and swore in Patrolman Ken Ridinger.  He questioned Patrolman Ridinger as to his position with the Police Department as well as the three summonses documented as Exhibits P-5 to P-8 and five (5) Notices to the Landlord documented as Exhibits P-8 to P-12 that were sent to Mr. Justice.

 

     Solicitor Pierson called his third witness, swore in Detective Sergeant Vern Morina and questioned Detective Sergeant Morina regarding the continuing offenses of 244 West Washington Street.

 

     Solicitor Pierson stated it seems it is the continuing nature of owner of 244 West Washington Street.  The Ordinance provides grounds for revocation of license.  It appears to be an ongoing continual problem, there is sufficient evidence, reason and justification to suspend or revoke the licensing effective in 60 days to allow for the removal of the tenant.

 

     R. #38.09:  RESOLUTION PROVIDING FOR AN EXECUTIVE SESSION OF BOROUGH COUNCIL OF THE BOROUGH OF PAULSBORO.  Haynes moved and Hamilton seconded to adopt R. #38.09.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     At this time, 5:35 p.m., Mayor convened in Executive Session to deliberate suspension or revocation of the Landlord License of the owner of 244 West Washington Street.

 

     Haynes moved and Hamilton seconded to open the meeting to the public at 5:45 p.m.  All were in favor of the motion.

 

     R. #39.09:  RESOLUTION OF THE BOROUGH OF PAULSBORO AUTHORIZING THE REVOCATION OF A LANDLORD LICENSE OF THE PROPERTY KNOWN AS 244 WEST WASHINGTON STREET.   Haynes moved and Hamilton seconded to adopt R. #39.09.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     This Resolution revokes the Landlord License for one year effective in 60 days.

 

     There wasn’t any further business regarding the Landlord Licensing Hearing.

 

     Haynes moved and Hamilton seconded to adjourn the Special Meeting at 5:48 p.m.  All were in favor of the motion.

 

     This is a brief summary of the Special Meeting of the Mayor and Council of the Borough of Paulsboro held on January 22, 2009 and should not be considered a verbatim transcript of the meeting.
