REGULAR MEETING

 

Council Chamber:

 

     Mayor Burzichelli presided at the Regular Meeting of Council held on the above date and place.

 

     Mayor Burzichelli called the meeting to order.

 

     Mayor Burzichelli asked resident Marc Kamp to light the Menorah and recite the Prayer of Menorah as the opening prayer.

 

     Mayor Burzichelli asked all those present to join in the salute to the flag, which was conducted by Borough Clerk VanScoy.

 

     Borough Clerk VanScoy read the opening statement regarding the Open Public Meetings Act.

 

     Members present were: Haynes, Hamilton, Kidd, Morina, Tedeski.  Absent:  Giovannitti (excused).

 

     Mayor Burzichelli opened the floor to the public.

 

     Ray Miller, Riverview Avenue, discussed the Resolution that was adopted at the last meeting for the transfer of the Liquor License for the Riverside Inn.  He wanted to know when the Resolution took effect.

 

     Mayor Burzichelli stated the Resolution would take effect from the date it was adopted except for the time constraints on the fences.

 

     Mr. Miller stated it has been a little more than one (1) month for the one fence and it hasn’t been installed yet.  He further stated some of the other issues on the Resolution haven’t been done yet either. He stated if the efforts and issues on the Resolution were followed then he felt it would work.

 

     Mayor Burzichelli stated if it is in violation then the owner should be put on notice.

 

     Fire Chief Licciardello, 520 Beacon Avenue, stated the Fire Company held their election and Fire Chief Licciardello was re-elected to the position of Fire Chief, Alfonse Giampola was elected as Deputy Fire Chief and Gary Stevenson was elected as Assistant Fire Chief.

 

     Emma Hackley, 201 West Buck Street, stated she was sorry to hear about the passing away of the Mayor’s mother.  She further stated Stonewall Stanley, a resident of Paulsboro, was 101 years old and also passed away. She questioned the solar field being built in West Deptford and was told that Paulsboro had a solar field too.

 

     Mayor Burzichelli stated there is a solar field in town on the BP site but the one in West Deptford is privately owned and a major development.

 

     Mrs. Hackley thanked the Police Department for being on the job when her alarm system went off.

 

     There wasn’t any further public participation.

 

     R. #185.10:  RESOLUTION PROVIDING FOR THE PAYMENT OF THE BILLS OUT OF THE 2010 BUDGET.  Haynes moved and Hamilton seconded to pay all bills properly signed and adopt R. #185.10. 

 

     Councilman Kidd questioned Purchase Order #39488 in the amount of $4,519.00.

 

     Chief Grogan stated it was for a new long block engine in one of the Ford vehicles.

 

     Roll call:  Ayes:  Haynes, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     R. #186.10:  RESOLUTION PROVIDING FOR THE CANCELLATION OF CERTAIN BALANCES ON WATER AND SEWER ACCOUNTS. 

 

     R. #187.10:  RESOLUTION PROVIDING FOR THE CANCELLATION OF CERTAIN BALANCES ON WATER AND SEWER ACCOUNTS.  Haynes moved and Hamilton seconded to adopt R. #186.10 and R. #187.10.  Roll call:  Ayes:  Haynes, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     R. #188.10:  RESOLUTION AWARDING A STATE CONTRACT, A-76357, FOR THE PURCHASE OF FIREFIGHTER PROTECTIVE CLOTHING AND EQUIPMENT FOR THE BOROUGH OF PAULSBORO.  Haynes moved and Hamilton seconded to adopt R. #188.10:  Roll call:  Ayes:  Haynes, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     R. #189.10:  RESOLUTION AUTHORIZING THE BOROUGH OF PAULSBORO TO CANCEL THE OUTSTANDING TAX BALANCE ON BLOCK 1.07 LOTS 21, 22, 24, 25, MANTUA AVENUE FOR THE YEAR 2010. 

 

     R. #190.10:  RESOLUTION AUTHORIZING THE BOROUGH OF PAULSBORO TO CANCEL THE OUTSTANDING TAX BALANCE ON BLOCK 106 LOT 3 (212 E. BROAD STREET) AND BLOCK 106 LOT 3.01 (210 E. BROAD STREET) FOR THE YEAR 2010.  Haynes moved and Hamilton seconded to adopt R. #189.10 and R. #190.10.  Roll call:  Ayes:  Haynes, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     R. #191.10:  RESOLUTION AUTHORIZING THE BOROUGH OF PAULSBORO TO CORRECT TAX BILLING ON BLOCK 90 LOT 8 (340 W. BUCK STREET) FOR THE YEAR 2010.  Haynes moved and Hamilton seconded to adopt R. #191.10:  Roll call:  Ayes:  Haynes, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried. 

 

     Summary of reports and copies of minutes of meetings.  Haynes moved and Hamilton seconded to receive and file.  All were in favor of the motion.

 

     SECOND READING AND PUBLIC HEARING:

 

     O. #13.10:  AN ORDINANCE OF THE BOROUGH OF PAULSBORO AMENDING CHAPTER 22, “CERTIFICATES OF OCCUPANCY” OF THE BOROUGH OF PAULSBORO.  Haynes moved and Hamilton seconded to open the meeting to the public.  All were in favor of the motion.

 

     There wasn’t any public participation.

 

     Haynes moved and Hamilton seconded to close the meeting to the public.  All were in favor of the motion.

 

     Haynes moved and Hamilton seconded to adopt O. #13.10 on second and final reading.  Roll call:  Ayes:  Haynes, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     INTRODUCTION AND FIRST READING:

 

    O. #14.10:  AN ORDINANCE OF THE BOROUGH OF PAULSBORO AMENDING CHAPTER 34A, “FIRE PREVENTION CODE” OF THE BOROUGH OF PAULSBORO.  Haynes moved and Hamilton seconded to adopt O. #14.10 on introduction and first reading and schedule the second reading and public hearing on December 20, 2010.  Roll call:  Ayes:  Haynes, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     INTRODUCTION AND FIRST READING:

 

     O. #15.10:  AN ORDINANCE OF THE BOROUGH OF PAULSBORO AMENDING OF CHAPTER 47 OF THE CODE OF THE BOROUGH OF PAULSBORO PROVIDING FOR REGULATIONS GOVERNING YARD SALES.  Haynes moved and Hamilton seconded to adopt O. #15.10 on introduction and first reading and schedule the second reading and public hearing on December 20, 2010.  Roll call:  Ayes:  Haynes, Hamilton, Morina, Tedeski.  Nays:  Kidd.  Motion carried.

 

     INTRODUCTION AND FIRST READING:

 

     O. #16.10:  AN ORDINANCE OF THE BOROUGH OF PAULSBORO AMENDING CHAPTER 76, PART 4, “PUBLIC PARKING LOTS” OF THE BOROUGH OF PAULSBORO.   Haynes moved and Hamilton seconded to adopt O. #16.10 on introduction and first reading and schedule the second reading and public hearing on December 20, 2010. 

 

     Councilman Kidd questioned how these ordinances came about.

 

     Solicitor DeTitto stated the above Ordinance regulates residents or non-residents leaving or staying in their cars overnight.

 

     Mayor Burzichelli explained the ordinances were recommended by the Crime Free Housing Committee.

 

     Councilman Kidd stated the committee is a committee recognized and appointed by the Mayor and he can’t see how the committee could bring something forward.

 

     Councilwoman Tedeski stated the Crime Free Housing Committee is made up of a variety of people and it was created to make the town better.  She further stated this ordinance was brought forth by the Code Office and questioned what other committee would bring it forth to Mayor and Council.

 

     Mayor Burzichelli stated it is long overdue housekeeping and felt Councilman Kidd should not be upset,

 

     Councilman Kidd stated if the Code Office brought this ordinance up then it should have went through the Code Committee.  He felt Council was going beyond the regular Council Committees.

 

     Mayor Burzichelli stated he disagreed with Councilman Kidd’s logic on how Ordinances are brought up.  He felt the agenda was appropriate and it was proper procedure.  He was not going to get into it any further.

 

     Roll call on O. #16.10:  Ayes:  Haynes, Hamilton, Morina, Tedeski.  Nays:  Kidd until he receives an opinion from the Solicitor.  Motion carried.

 

     Letter from Nick L. Petroni, Petroni & Associates, LLC, regarding 2009 Audit.   Haynes moved and Hamilton seconded to receive and file the letter.  All were in favor of the motion.

 

     R. #192.10:  RESOLUTION REQUIRING THE GOVERNING BODY OF THE BOROUGH OF PAULSBORO TO ADOPT THE ANNUAL AUDIT PURSUANT TO N.J.S.A. 40A:5-4. 

 

     Councilman Kidd questioned if this matter was going to be discussed at another time as it states things that have to be corrected and things that haven’t been corrected.

 

     Haynes moved and Hamilton seconded to adopt R. #192.10.  Roll call:  Ayes:  Haynes, Hamilton, Morina, Tedeski.  Nays:  Kidd (“make sure things get done and corrected”.)  Motion carried.

 

     Receipt of Bids:  Procurement of the Water Treatment Equipment:

 

     1.  Hungerford & Terry                             $689,970.00

 

     Haynes moved and Hamilton seconded to receive, file and spread the bids in the minutes.  All were in favor of the motion.

 

     R. #193.10:  RESOLUTION AWARDING CONTRACT TO HUNGERFORD & TERRY OF CLAYTON, NEW JERSEY FOR THE PROCUREMENT OF THE WATER TREATMENT EQUIPMENT FOR THE BOROUGH OF PAULSBORO.  Haynes moved and Hamilton seconded to adopt R. #193.10.  Roll call:  Ayes:  Haynes, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     Letter from John J. Vinci, Sr., The Gloucester County Utilities Authority, regarding Public Hearing GCUA Operating Budget and Proposed Rate Schedule. 

 

    Councilman Kidd questioned this matter and informed everyone that it is a 5% increase.

 

     Mayor Burzichelli stated it has increased every year.

 

     Haynes moved and Hamilton seconded to receive, file the letter and send a letter of objection and hardship to the GCUA.  All were in favor of the motion.

 

     Letter from resident, Ruth L. Driver, requesting permission for the use of the shuttle bus to transport the senior citizens of Paulsboro to the away wrestling matches.  Haynes moved and Hamilton seconded to receive, file the letter, approve their request with the same format as last year and it is to be coordinated by Councilman Giovannitti.  All were in favor of the motion.

 

     Received Raffle License Application from George D. Patton VFW, RA-542, for July 2010 to June 2011 instant raffle license.  Haynes moved and Hamilton seconded to receive, file and approve the above license.  All were in favor of the motion.  

 

     Letter from Mark Brunermer, Sickels & Associates, Inc., regarding proposal for Professional Services NJDOT Municipal Aid Program Reconstruction of Billings Avenue – Phase III (in response to the request for sealed qualifications for Professional Services under a fair and open process).  Haynes moved and Hamilton seconded to receive and file the letter.  All were in favor of the motion.

 

     R. #194.10:  RESOLUTION AUTHORIZING THE BOROUGH COUNCIL TO ENTER INTO AN AGREEMENT AUTHORIZING PROFESSIONAL SERVICES BY AN ENGINEER PURSUANT TO N.J.S.A. 40A:11-1, et seq. (Special Road Project – Reconstruction of Billings Avenue – Phase III).   Haynes moved and Hamilton seconded to adopt R. #194.10.  Roll call:  Ayes:  Haynes, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     R. #195.10:  RESOLUTION AUTHORIZING THE RETENTION OF LINCOLN FINANCIAL AS LENGTH OF SERVICE AWARD PROGRAM (LOSAP) ADMINISTRATORS FOR THE BOROUGH OF PAULSBORO FIRE DEPARTMENT.  Haynes moved and Hamilton seconded to adopt R. #195.10:  Roll call:  Ayes:  Haynes, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     R. #196.10:  RESOLUTION OF THE BOROUGH OF PAULSBORO

AUTHORIZING A PROFESSIONAL SERVICES CONTRACT BETWEEN PARKER MCCAY, P.A. AND THE BOROUGH OF PAULSBORO FOR SERVICES ASSOCIATED WITH A USDA FUNDED PROJECT FOR CONSTRUCTION OF A NEW WATER TOWER.  Haynes moved and Hamilton seconded to adopt R. #196.10:  Roll call:  Ayes:  Haynes, Hamilton, Kidd, Morina, Tedeski.  Nays:  None.  Motion carried.

 

     OLD BUSINESS:   There wasn’t any old business at this time.

 

   

 

     MAYOR AND COUNCIL REPORTS:

 

     Councilwoman Tedeski asked wasn’t it stated Council was not going to run the bus due to budget constraints.

 

     Mayor Burzichelli stated it was to be run on a limited basis and the Borough should be able to figure it out but if not then he will pursue donations to run the bus for the Senior Citizens.

 

     Councilwoman Tedeski stated the Holiday Tree Lighting was held on Saturday and she thanked everyone for their help especially Councilman Giovannitti who donated the hot chocolate.  Marc Kamp took 120 pictures with Santa.  She again thanked everyone for their efforts especially the Fire Department.

 

     Councilwoman Tedeski stated the Paulsboro Day Committee did an outstanding job with Paulsboro Day.

 

     Councilman Tedeski further stated the Paulsboro Day Committee is holding a raffle on December 27th for a basket of cheer and if anyone wanted a ticket to see a member of the Paulsboro Day Committee.

 

     Councilwoman Tedeski reported on the Crime Free Housing Committee Meeting.  They had the owners of Wally’s and the Paulsboro shopping complex present to address the loitering problem.  There were ideas shared and they are working towards solutions to help the business owners and the business owners will help them.  She thanked Solicitor DeTitto for all her hard work on the ordinances.  She also stated the purpose of the parking lot ordinance was to help businesses.  She also thanked Patrolman Ken Ridinger and Code Enforcement Officer Keith Hogle.

 

     Councilman Morina echoed Councilwoman Tedeski’s sentiments regarding the Crime Free Housing Committee Meeting.

 

     Councilman Morina stated the High School is holding their annual Christmas Party on December 11th at the High School at 10:00 a.m.

 

     Councilman Morina commended the Neighborhood Watch Association as they were able to support two (2) families for the Christmas holiday.

 

     Councilman Morina also stated if anyone has anything to place in “The Record” to let him know.

 

     Councilman Hamilton congratulated Detective Sergeant Vern Marino as he competed in a 50 mile run in the Washington DC and Maryland area.

 

     Councilman Hamilton congratulated Michael Licciardello on his re-election as Fire Chief.

 

     Councilman Hamilton thanked everyone for the Holiday Tree Lighting on Saturday, December 4th and wished everyone Happy Holidays.

 

     Councilman Kidd stated he received a fax today that Valero has sold to BP Energy as of December 17th and it will be a smooth transition.

 

     Councilman Kidd discussed procedures and protocols.

 

     Councilman Kidd thanked the Street and Highway Department for doing a good job collecting the leaves.  He felt a few years ago there was Community Service to help with the collection and if the Borough had more Community Service involved they would have been able to have two crews collecting as well but they have done a good job.

 

     Councilman Kidd stated a resident has passed away that was 100 years old and wished he would be recognized.

 

     Mayor Burzichelli stated it would not be a motion but to just send a nice note.

 

     Councilman Kidd stated he went to the JIF seminar and felt kind of alone as he sat with committee members from Elk Township.  He discussed Workmen’s’ Comp and safety as it was very interesting.  He felt the Borough has been lucky as far a safety went.

 

     Mayor Burzichelli stated the Borough has been recognized consecutively for its in house safety program from the JIF.

 

     Council President Haynes also questioned himself on how the Ordinances make it on the Agenda.  He felt Council should possibly get a brief on it, where it has come from, why and what committee.

 

     Council President Haynes wished everyone a safe and Happy Holiday and informed everyone to love their family.

 

     Mayor Burzichelli thanked everyone for coming to the meeting.  He felt Council President Haynes makes a good idea regarding the ordinances for feedback from the committees and the Ordinances would move more expeditiously.

 

     Councilwoman Tedeski stated the discussion regarding the land purchase/easement will be moved to the Work Session Meeting.

 

     Fire Chief Licciardello reminded everyone Santa will be around this weekend.

 

     There wasn’t any further Borough business.

 

     Haynes moved and Hamilton seconded to adjourn the meeting at 8:00 p.m.  All were in favor of the motion.
