WORK SESSION MEETING

 

Council Chamber:

 

     Mayor Burzichelli presided at a Work Session Meeting of Council held on the above date and place.

 

     Members present were: Haynes, Giovannitti, Hamilton, Kidd, Tedeski.  Absent:  Morina (excused).

 

     Mayor Burzichelli called the meeting to order.

 

     Mayor Burzichelli read the opening statement regarding the Open Public Meetings Act.

 

     Mayor Burzichelli opened the floor to the public.

 

     There wasn’t any public participation.

 

     Minutes of a Work Session Meeting held on November 15, 2010 at 5:00 p.m.  Haynes moved and Hamilton seconded to receive, file and approve the above minutes.  All were in favor of the motion.

 

     R. #197.10:  RESOLUTION PROVIDING FOR THE PAYMENT OF THE BILLS OUT OF THE 2010 BUDGET. 

 

     Mayor Burzichelli added a purchase order, #39777, to Maley & Associates in the amount of $4,072.50.

 

     Haynes moved and Hamilton seconded to pay all bills properly signed and adopt R. #197.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Tedeski.  Nays:  None.  Motion carried.

 

     R. #198.10:  RESOLUTION PROVIDING FOR THE TRANSFER OF FUNDS FROM CERTAIN ACCOUNTS TO OTHER ACCOUNTS IN THE 2010 BUDGET.  Haynes moved and Hamilton seconded to adopt R. #198.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Tedeski.  Nays:  None.  Motion carried.

 

     R. #199.10:  RESOLUTION PROVIDING FOR THE CANCELLATION OF    CERTAIN BALANCES IN THE 2010 BUDGET TO SURPLUS.  Haynes moved and Hamilton seconded to adopt R. #199.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Tedeski.  Nays:  None.  Motion carried.

 

     R. #200.10:  RESOLUTION OF THE BOROUGH OF PAULSBORO URGING THE STATE LEGISLATURE TO AMEND 18A:30-2.1 AND 11A:6-8 TO ELIMINATE SICK LEAVE INJURY. 

 

     R. #201.10:  RESOLUTION OF THE BOROUGH OF PAULSBORO SUPPORTING S-2402 CAPPING ATTORNEY FEES IN LITIGATION    AGAINST PUBLIC ENTITIES.  

 

     R. #202.10:  RESOLUTION OF THE BOROUGH OF PAULSBORO SUPPORTING A3431 TO AMEND TITLE 59 BY GRANTING IMMUNITY TO PUBLIC ENTITIES FOR SIDEWALK INJURIES WHERE THE HOMEOWNER IS RESPONSIBLE FOR SIDEWALK MAINTENANCE BY ORDINANCE. 

 

     R. #203.10:  RESOLUTION OF THE BOROUGH OF PAULSBORO SUPPORTING A-3420 TO AMEND TITLE 59 BY STRENGTHENING WEATHER IMMUNITY. 

 

     R. # 204.10:  RESOLUTION OF THE BOROUGH OF PAULSBORO SUPPORTING S-2333 AND A-3432 TO AMEND TITLE 59 TO PROVIDE IMMUNITIES FOR BEACHES, BOARDWALKS AND SIMILAR PROPERTY. 

 

     Haynes moved and Hamilton seconded to adopt R. #200.10, R. #201.10,

R. #202.10, R. #203.10 and R. #204.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Tedeski.  Nays:  None.  Motion carried.

 

     R. #205.10:  RESOLUTION APPROVING PREMIUM ONLY SECTION 125 PLAN WITH OPT-OUT FOR THE BOROUGH OF PAULSBORO.  Haynes moved and Kidd seconded to adopt R. #205.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Tedeski.  Nays:  None.  Motion carried.

 

     R. #206.10:  RESOLUTION OF THE BOROUGH OF PAULSBORO CALLING ON THE STATE LEGISLATURE AND THE GOVERNOR TO EXEMPT THE RESERVE FOR UNCOLLECTED TAXES FROM THE 2% CAP.  Haynes moved and Hamilton seconded to adopt R. #206.10.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Tedeski.  Nays:  None.  Motion carried.

 

     Ordinance #s 14.10, 15.10 & 16.10 will not be held at this meeting due to an advertisement error and will be reintroduced at the Reorganization Meeting.

     Haynes moved and Hamilton seconded to receive, file and spread the bids in the minutes.  All were in favor of the motion.

 

     Administrator Salvatore explained that the bids came in higher than budgeted; therefore the Mayor and Council would not be able to award the bid until the Reorganization Meeting as well as amend the temporary budget.

 

     Letter from Erik Biermann, Sickels & Associates, Inc., regarding Receipt of Sealed Bids for the Reconstruction of Water Treatment Plant.  Haynes moved and Hamilton seconded to receive and file the letter.  All were in favor of the motion.

 

     Letter from Joseph L. Achey, Wheelabrator Gloucester Co., L.P., regarding contract pricing effective January 1, 2011.  Haynes moved and Hamilton seconded to receive and file the letter.  All were in favor of the motion.

 

     Received Bingo License Application, BA-543, Paulsboro Volunteer Fire Assoc. #1, Inc. for their annual Bingos.  Haynes moved and Hamilton seconded to receive, file the application and approve the bingo license.  All were in favor of the motion.

 

     Memo from Administrator Salvatore regarding Bond Anticipation Note.  Haynes moved and Hamilton seconded to receive and file the memo.  All were in favor of the motion.

 

     Councilwoman Tedeski discussed the Pilger land purchase/easement.  She felt the Governing Body collectively did not want to sell the land but would consider an easement which would have to be prepared.

 

     Solicitor DeTitto stated there should be some restrictions on the easement such as when the easement would cease, who would maintain the easement, if concrete would be placed or other options for a driveway, etc.

 

     Linda and Wayne Pilger, 600 King Street, stated they are only interested in the 40 foot wide portion of the property which they have been maintaining.  They would like the section that goes along their property to put stone down, fence off and put in a driveway gate.

 

     Mayor and Council further discussed the usage of the property for any other property owners’ whose land also abuts the property.

 

     Council President Haynes stated he did not see any other usage for any other property owners’.

 

     Solicitor DeTitto stated the next step would be to consider what type of restrictions and extinguishing language that is to be placed in the easement.

 

     Mayor Burzichelli suggested this matter go back to Councilwoman Tedeski’s committee for their input on such language.

 

     Police Chief Grogan discussed the liquor license violations for Bennie’s on the Rail.  He felt the Governing Body should conduct a hearing to entertain the charges and possible suspend or fine them.

 

     Haynes moved and Hamilton seconded to schedule a special meeting on January 11, 2011 at 5:00 p.m. to hold a hearing for the Liquor License.  Roll call:  Ayes:  Haynes, Giovannitti, Hamilton, Kidd, Tedeski.  Nays:  None.  Motion carried.

 

     Chief Grogan reported that it has been fairly quiet as to burglaries.  In the Wachovia Bank robbery, the suspect admitted to robbing the bank.

 

     Chief Grogan stated patrols noticed a van parked in the Gas Station with two people hiding inside.  It appears they broke into the Paulsboro Plaza and caused a lot of damage.  It appears they were stealing the copper wiring.  It was a good arrest.

 

     Chief Grogan stated the internet in the Police Department is now working.  He further stated that by spring all cars will have new computers installed and the software will come from the County.

 

     Councilman Hamilton stated on Saturday night on Paul Avenue from Broad Street to Swedesboro Avenue there was some break-ins of cars.  He also stated there is a young adult lady out setting people up.  She asks for help and then once she gets the individual to help, several guys jump out and rob them.  He was just letting everyone know not to fall for this scam.

 

     Mayor Burzichelli wished everyone a Merry Christmas.

 

     There wasn’t any further Borough business.

 

     Haynes moved and Hamilton seconded to adjourn the meeting at 6:02 p.m.  All were in favor of the motion.
